Biden Calls for Sweeping Reforms to U.S. Supreme Court Amid Controversial Immunity Ruling

 

In a powerful address on Monday, President Joe Biden challenged the integrity of the U.S. Supreme Court and called for significant reforms, spotlighting the recent decision in Trump v. United States. Speaking at the 60th anniversary of the Civil Rights Act in Austin, Biden condemned the ruling that grants broad immunity to presidents from criminal prosecution, likening it to placing them above the law.

Biden criticized this decision as creating a "king-like" status for presidents, describing it as “fundamentally flawed” and “dangerous.” He argued that this immunity undermines the core principle of accountability, which is crucial to a nation governed by laws, not by autocrats.

The ruling in question, which provides expansive protection to presidents exercising their official duties, is part of a series of controversial decisions that Biden believes have eroded long-standing civil rights protections. He drew parallels between this decision and other recent rulings that have dismantled parts of the Voting Rights Act and overturned Roe v. Wade, arguing that these actions starkly contrast with the civil rights advancements of the past.

In response, Biden proposed a new constitutional amendment aimed at ensuring that presidents are subject to the same criminal codes as other citizens. He emphasized that such a measure is essential to prevent any president from wielding undue power without consequence.

“This administration, like no other, has called for accountability from its leaders,” Biden said. “We are a nation of laws, not kings and dictators.”

The proposed amendment would require substantial legislative support, needing two-thirds of both the House and Senate, as well as ratification by three-quarters of the states. Biden’s call for reform also includes a push for a binding code of conduct for Supreme Court justices and term limits. He noted that the U.S. is unique among Western democracies in granting lifetime appointments to its highest court.

Biden’s reform agenda echoes proposals from Georgia Representative Hank Johnson, who has advocated for term limits and a stricter ethical code for the Supreme Court. Johnson’s proposed legislation includes the Term Act, which would establish 18-year staggered terms for justices, and the Supreme Court Ethics, Recusal, and Transparency Act to enforce ethical standards.

Despite the push for these reforms, Johnson acknowledged the challenge of overcoming potential judicial rulings that could declare such reforms unconstitutional. He warned that ignoring the rule of law could destabilize the democratic framework of the country, drawing historical comparisons to President Andrew Jackson’s defiance of the Supreme Court on Native American removal issues.

As debates over these proposals continue, Biden’s address underscores a growing concern about the balance of power within the U.S. judiciary and the need for reforms to ensure its accountability and fairness.
