U.S. District Judge Mark Scarsi, who presided over Hunter Biden's federal tax case, has issued a sharp rebuke to President Joe Biden for his decision to pardon his son this week. The judge accused the president of misrepresenting the facts of Hunter Biden's case and criticized the rationale behind the clemency, including remarks that undermined law enforcement and the justice system.
Judge Scarsi, a Trump appointee, raised questions about the constitutionality of the pardon, which absolves Hunter Biden of federal offenses over an 11-year span. This includes wiping out a Delaware jury's verdict that convicted Hunter Biden of illegally purchasing a firearm. The decision has drawn criticism from both Republicans and Democrats, marking a contentious chapter in the Biden administration.
Scarsi particularly took issue with the president's claim that his son was treated unfairly compared to others who faced tax issues due to personal struggles. “The President asserts that Mr. Biden ‘was treated differently’ from others ‘who were late paying their taxes because of serious addictions,’” Scarsi noted, but added that the tax evasion occurred after Hunter Biden had reportedly overcome his addiction.
The judge highlighted that Hunter Biden misclassified personal expenditures, including luxury items, escort services, and his daughter’s tuition, as business expenses—actions that did not align with the president’s framing of the case as one rooted in addiction-related struggles.
Scarsi also refuted the president's assertion that Hunter Biden was singled out because of his last name, emphasizing that two federal judges had previously dismissed claims of biased prosecution. He pointed out that the investigation and charges were overseen by the Department of Justice, led by Attorney General Merrick Garland, who was appointed by President Biden.
“In the President's estimation, this legion of federal civil servants, the undersigned included, are unreasonable people,” Scarsi wrote, underscoring his disagreement with the president’s characterization of the justice system.
The pardon has sparked widespread criticism, even within the president’s party, with detractors arguing that it undermines public trust in the legal system. Republicans have seized on the controversy, citing it as evidence of favoritism and a lack of accountability.
The White House has yet to respond to Scarsi’s remarks, leaving questions about the long-term implications of the president’s decision unanswered.
