New York Appeals Court Denies Trump’s Bid to Lift Gag Order in Hush-Money Case

 

In a decisive ruling on Thursday, a New York appeals court upheld a gag order imposed on former President Donald Trump in connection with his hush-money criminal case. The court's five-judge panel rejected Trump's argument that his May conviction represented a "change in circumstances" warranting the removal of the gag order.

The gag order, first implemented in March by Judge Juan Merchan, was put in place following concerns that Trump was using his platform to attack individuals involved in his legal proceedings. During the trial, Trump was held in contempt of court for violating this order and fined $10,000. Judge Merchan warned of potential jail time for further infractions.

While some restrictions were eased in June, allowing Trump to comment on witnesses and jurors, the gag order remains in effect regarding trial prosecutors, court staffers, and their families, including Trump's own daughter. The order will remain in place until sentencing, which was initially scheduled for July 11 but has been postponed to September 18.

Trump's legal team has sought to overturn his 34 felony convictions by arguing that certain evidence admitted during the trial should be excluded based on a Supreme Court ruling on presidential immunity. The argument, however, does not claim that Trump's actions were official acts of his presidency, but rather that some evidence should not have been used because it pertained to presidential activities.

Prosecutors counter that the Supreme Court ruling does not impact the convictions, asserting that the contested evidence relates to unofficial conduct or, if it involves official acts, any presumption of immunity has been rebutted.

In a related legal matter, U.S. District Judge Aileen Cannon in Florida dismissed charges in Trump’s case involving classified documents, citing concerns about the constitutionality of the special counsel appointment. This dismissal was influenced by a concurring opinion from Supreme Court Justice Clarence Thomas.

As Trump's legal battles continue, the gag order remains a key element in ensuring a fair and impartial process, reflecting ongoing tensions in the high-profile case.
