The lawsuit, originally filed in January, alleged that UMG engaged in defamation by promoting the song, which originated from Drake’s rap battle with Lamar. However, on October 9, District Judge Jeannette Vargas dismissed the case, ruling that the song constituted a “nonactionable opinion” rather than a defamatory statement. Judge Vargas noted that, within the context of a rap battle, listeners could reasonably expect hyperbole, fiery rhetoric, and epithets, even if statements appear factual.
Drake’s legal team has now signaled that they intend to appeal the dismissal, with further arguments expected to be submitted to the Court of Appeals in the coming weeks.
UMG has not yet responded to the filing. Drake’s amended complaint had focused on events after the initial filing, including Lamar’s performance of “Not Like Us” at the Super Bowl and the track’s play at the 2025 Grammy Awards.
This appeal sets the stage for a continued legal battle over what constitutes defamation in the context of public musical performances and rap battles.
