Nigeria Imposes $220 Million Fine on Meta for Data Privacy Violations

 

The Federal Government of Nigeria has fined Meta Platforms Inc., the parent company of WhatsApp, Facebook, and Instagram, $220 million for alleged breaches of data privacy regulations. The fine was announced on July 19 by the Federal Competition and Consumer Protection Commission (FCCPC).

According to FCCPC Acting Chief Executive Officer Adamu Abdullahi, Meta violated multiple provisions under the Federal Competition and Consumer Protection Act (FCCPA) 2018 and the Federal Competition and Consumer Protection (Administrative Penalties) Regulations 2020 (APR). The infractions include unauthorized sharing and transfer of Nigerian data, violations related to cross-border data storage, discriminatory practices, abuse of market dominance, and inadequate respect for Nigerian users' data rights.

The FCCPC's statement detailed the investigation process, which began in May 2021. Over the following months, the commission, alongside the Nigeria Data Protection Commission (NDPC), reviewed Meta's data practices and privacy policies. Despite Meta’s cooperation in providing some information and engaging with investigators, the commission found persistent violations.

The FCCPC emphasized that Meta's actions involved multiple breaches, including unauthorized data transfers and failure to provide Nigerian users with control over their personal information. The imposed fine reflects Nigeria's commitment to enforcing data privacy standards and regulating tech companies operating within the country.

The commission's final order requires Meta to comply with Nigerian data protection laws and halt practices that exploit Nigerian consumers. The $220 million penalty is in line with the FCCPA 2018 and the APR regulations.
