An Instagram model, Luisa Kremleva, accused of making a false rape allegation against AC Milan defender Theo Hernandez, is set to go on trial later this month. The proceedings will take place at a Costa del Sol court, where public prosecutors are seeking a two-year prison sentence and a fine of £12,000 if she is found guilty.
Kremleva, who is believed to hold dual Russian-Spanish nationality, reported to the police that she was raped in a Porsche Cayenne outside the popular Marbella nightclub Olivia Valere. She claimed that Hernandez pushed her out of the vehicle, causing knee injuries after allegedly forcing himself on her.
However, the case took a turn when prosecutors intervened after a court archived Kremleva's rape claim. Police obtained CCTV footage showing that her knee injuries were sustained in a fall outside the nightclub, leading a judge to rule that there was no evidence to support her allegations.
Kremleva was later arrested after unsuccessful attempts to serve her with a court summons. Prosecutors have accused her of acting "maliciously" by claiming that Hernandez raped her after he rejected her advances to return home with her following what she described as consensual sex in the car.
Following the news of her detention on January 13, 2020, Kremleva's mother appeared on Spanish television, asserting that her daughter was not under arrest but had gone to collect a court notification. She expressed confidence that "the truth will come out."
Kremleva herself took to social media to clarify, stating, "I have not been arrested. I have not been convicted of any crime. The truth will come out."
Sources from the court have confirmed that Kremleva's trial is scheduled for October 28 at a court in Malaga.
