Nigeria’s Federal Competition and Consumer Protection Commission (FCCPC) has issued a significant indictment against Coca-Cola Nigeria Limited and the Nigerian Bottling Company (NBC) for alleged deceptive marketing practices. The commission's statement, released on Thursday, accuses the companies of misleading trade descriptions and unfair marketing tactics involving their 'Original Taste, Less Sugar' product.
The FCCPC’s investigation, which has spanned several years, concluded that Coca-Cola Nigeria Ltd and NBC were misleading consumers by misrepresenting the 'Original Taste, Less Sugar' variant as being similar to the original 'Original Taste' variant in terms of formulation. This, the FCCPC claims, violated Section 116 of the FCCPC Act and Section 124(1)(a) of the Commission’s Establishment Act.
The commission detailed its findings in a Final Order issued on July 29, 2024, highlighting two main areas of concern:
Misleading Trade Descriptions: Coca-Cola Nigeria and NBC were found to have misled consumers into believing that the 'Original Taste, Less Sugar' product was not materially different from the 'Original Taste' variant. This is in violation of Section 116 of the Federal Competition and Consumer Protection Act (FCCPA).
Unfair Marketing Tactics: The commission also criticized the companies for their marketing practices. According to the FCCPC, the packaging of the 'Original Taste, Less Sugar' product was either indistinguishable or insufficiently distinct from the original 'Original Taste' product, breaching Sections 123(1)(a), (b), and (c) of the FCCPA.
The FCCPC has reserved further regulatory action and penalties related to potential abuse of dominance for future consideration. The commission’s Final Order signifies a serious response to what it sees as ongoing and systemic issues in the companies’ marketing practices.
As of now, Coca-Cola Nigeria and NBC have not publicly responded to these allegations. The outcome of this case could have significant implications for how food and beverage companies market their products in Nigeria, particularly regarding transparency and consumer protection.
The FCCPC’s actions reflect a growing focus on ensuring that companies adhere to fair marketing practices and provide clear, accurate information to consumers. This case underscores the importance of regulatory oversight in maintaining market integrity and protecting consumer rights.
